ABOUT MY ARTISTAMPS & ALL MY DESIGNS

This is how I see things with MY ART AND MY RIGHTS. If you trade with me MY ARTISTAMPS/CARDS/OR OTHER OF MY CREATIVE PIECES you will be receiving:
- (In case of "ARTISTAMPS") AN ORIGINAL PRINTER-COPY WITHOUT WATERMARK AND SIGNED BY ME AND PRINTED ON SPECIAL PAPER OF MY ART-DESIGN-DRAWING-ILLUSTRATION PIECE.
- MY PERMISSION for you to USE WITHOUT DESIGN MODIFICATION my art-design-drawing-illustration AS AN ARTISTAMP or ANY THEME RELATED TO IT. You must always keep my signature and give me the credit of the art. You can use the ARTISTAMP in any size you want, you can reduce it, amplify it, reproduce it, color it, swap it, etc but you cannot alter the design, you cannot modify my art-design-drawing-illustration nor sell it.

WHAT YOU ARE NOT RECEIVING?
- YOU ARE NOT RECEIVING the rights (my rights) on my art-design-illustration, this one is and will always be mine. You cannot modify it and you cannot say it is yours. There is a simple formula for this: "Did you do it? The idea/conception/traces are yours -from your mind? YES? Then, it´s yours (you can modify it and do whatever you like with it). NO? Then it´s not yours, it´s mine and if you don´t have my permission YOU CANNOT ALTER IT". Its appearence or publication in web sites (as IUOMA) or editorial prints (as books, posters...) DOES NOT ELIMINATE NOR "CAMOUFLAGES" my rights on it, my copyrights and my permissions. If you are an artist of any discipline you understand this.
- YOU ARE NOT RECEIVING my permission to use my art-design-drawing-illustration on things, commodities or "products" you want to sell, not even keeping my signature nor even giving me the credit of the art. It is and always be my art-design-drawing-illustration, my copyrights, and any "product" selled or distribution of it with a payment involved- must benefit me as an income for my art-design-drawing-illustration.

CAN SOMEBODY VIOLATE MY RIGHTS?
Of course anybody can! They can cause I won´t be there to see it happen, right? But this is a crime, even inside the internet and is called "stealing", "plagiarism". And, as far as I know, almost all members of creative communities are fighting to stop it. A crime is a crime, no matter if it´s done publicly or privately or "with no-bad intentions".

WHAT´S THE ALTERNATIVE TO THIS?
GET IN CONTACT WITH ME. Let me know you are interested on selling something with my art-design-drawing-illustration. I´m fully dedicated to my art-design-drawing-illustration so it can be an incentive to keep me enhancing it and -who knows- maybe I can even send you a special version for your product.
Nevertheless, you still won´t be able to say my art-design-drawing-illustration is yours and you still won´t be able to modify anything without permission, not even "just a certain percent of it" cause you will be altering it and violating my rights.

This is how I see some of my rights on my art-design-drawing-illustration. I think they are common-sense things, not obstacles for nice swaps and getting to know mail artists around the world. If you are interested, please let me know. You will surely make us our day. Who knows! :)

Best regards
Marissa

Hi Katerina! Actually not only things "for commercial value" are protected by the International Copyright Treaties and the property organizations, all creative production is. The thought that creative people shouldn´t publish what they don´t want to be used in a way they don´t want it is almost as saying that somebody shouldn´t leave the house if doesn´t want to be raped.  In our free world and when it has been claimed on an explicit way there are no ways to avoid or disguise a damage, at least that´s what creative communities are fighting for. I sincerely respect your opinion about the decisions you take to protect your art but that doesn´t apply to everybody´s art. I guess each creative person has to take the own decisions and sometimes, yes, it might sound rude but it really isn´t, they are things of common-sense that protect us all in our free world, I think.

Thanks for your comment Katerina

I like getting artistamps and stickers from other mail artists. I often photocopy them and use them on Add/Pass pages or on my mail art. They get "passed around" the world to other mail artists.

As they are not for commercial value, there shouldn't be a copyright issue then, right? I try to mention the artist who did the artistamp or sticker, but there is often not room on a card or collage. Most mail artists recognize the artist  and know it is not my work, or a collaboration. I don't copyright my mail art, as it is of "no commercial value", and I feel honored when i see something of mine used in a poster, pamphlet, or even "recycled" in bits and pieces in another artist's collage. Often in the "spirit of DADA" we add to, alter, reuse, recycle, etc.

Posting here at IUOMA or at private blogs is a way of sharing the art we receive. If someone does not want their art to go public here at IUOMA...then don't sent it, or mark on it "not for sharing on blog". However, I feel that the whole point of making and sending mail art is to have go "out there"...to go to the public, the postal clerk, the mailman, the mail artist that we exchange with...it is not "locked up" in a private art collection or art gallery.
